I think it would depend on how they categorize the killer? Is it the person who made it, or the person who gave it to the victim?

Would knowing about it make a difference? If you knew it was jacked up and gave it to someone you're absolutely a killer, but like, if you didn't know and someone else just messed it up with the intention of getting whoever drank from it...

It might depend. Peanuts, for example. You might use peanut oil in the cooking.

They should still, like, ask if there's anything peanut related in the dish if they know they have the allergy though... then whoever used the peanut oil could say, "Oh shit, don't eat that!"
